Description

Short title: Attorney General [of the Duchy of Lancaster] v Greene.

Plaintiffs: Attorney General [of the Duchy of Lancaster] at the relation of Nicholas Booth.

Defendants: Hugh Greene and Edward Greene.

Documents: depositions concerning bailiff's rights in Fairfield, Derbyshire.

Taken September, 32 Eliz.

Deponents for plaintiffs: Humphrey Dakin of Chelmorton, yeoman, aged 77, deposed that Raphe Blackwall [gentleman] had been baliff in the time of Henry VII. The current bailiff was asserting rights to certain lands known as the bailiff's yard and that he has attempted to build a cottage in which to house tenants. He was prevented from doing so by the inhabitants; Thurston Goodyn of the Peak Forest, husbandman, aged 80; Anthony Buxton of Fairfield. husbandman, aged 55; George Goodyn of Cowlow, yeoman, aged 67; Alex Curtes of Fairfield, yeoman, aged 70; Thomas Cocker of Fairfield, yeoman, aged 77; William Henshawe of Fairfield, aged 68. Two deeds were presented to the court both dating to 36 Hen VIII [1544]. The commissioners met with 'many people' and went on a perambulation of the lands in question. Bounds recited.

Deponents for defendants: Thurston Allen of Whetstone, gentleman, aged 82; John Ferne of the Green near Buxton, yeoman, aged 72; Edward Needham of the Green near Buxton, yeoman, aged 77; John Dakin of Pigtorr, husbandman, aged 70. Two documents were produced for the defendant, dating to Hen VI.
