Plaintiffs: Henry Cavendish.

Defendants: Thomas Roger and Edward Wheeldon.

Deponents for plaintiffs: Nicholas Heathcoate of Cowdale, husbandman, aged 79, whose memory goes back 60 years and more [to 1524]; Nicholas Wheeldon of Earls Frith, husbandman, aged 60, whose memory goes back always [to 1524]; Richard Bateman of Hartington, yeoman, aged 60, whose memory goes back 50 years or more [to 1534]; John Wheeldon of Greenside, aged 80, whose memory goes back 60 years and more [to 1524]; Humphrey Goodwin of Earls Sterndale, husbandman, aged 45, deposed that he 'had a writinge in his keepinge wch was told him was a bondary but what land ytt conteyned he knoweth not for this exacet he can neyther writ nor ryde nor evr hard yett read wch said writinge he delyved to Mr Aden Berresford' [had a writing in his keeping which was told him was a boundary but what land it contained he knows not for this exact he can neither write nor read nor ever heard yet read which said writing he delivered to Mr Aden Beresford]; William Fletcher of Longnor, Staffordshire, husbandman, aged 86, deposed that he 'had a copye in his keepinge that was graunted of the said dowley more and hyndlowe to the inhabitants of Earles Sternedale for ev but by whoe or to what p[er]sons by name ytt was graunted he remembreth not And saythe that the same copye was taken out of this deponts house when he was in the warres by his sonne in lawe Robte Stadon who as this depont heard delyved yt to one Nicholas Godwin' [had a copy in his keeping that was granted of the said Dowley Moor and Hyndlowe to the inhabitants of Earls Sterndale for ever but by who or to what persons by name it was granted he remembers not. And says that the same copy was taken out of this deponent's house when he was in the wars by his son in law Robert Stadon who as this deponent heard delivered it to one Nicholas Godwin]. On Godwin's death he left it to his son Humphrey, who passed it on to Aden Beresford; Edward Wardle of Earls Booth, husbandman, aged 60, whose memory goes back 40 years [1544].

Deponents for defendants: Humphrey Goodwin of Crowborough, Staffordshire, yeoman, aged 75, born half a mile from disputed lands; Richard Frost of Fairfeidhead, Staffordshire, husbandman, aged 87, whose memory goes back always [to 1497], deposed that his grandfather and father had lived in Earls Sterndale and that the lands were always common in their time. Both lived until they were 80.
