Plaintiffs: Elizabeth Pawlett.

Defendants: Sir Thomas Cockaine.

Documents: depositions concerning the rights for grinding grain at Ashbourne, Derby, and Compton, Derbyshire.

Deponents for plaintiffs: Robert Robothom of Ashbourne, shoemaker, aged around 28, deposed that shortly after the erection of the mill in Compton, one of Cockaine's servants came to him and told him that if he ground his corn at the Compton mill 'that sir Thomas his master wold pleasure him wth some grasse of a reasonable price when he myght so use hyt' [that Sir Thomas his master would pleasure him with some grasse of a reasonable price when he might so use it]; Humphrey Sherwyn of Uttoxeter, Staffordshire, miller, aged around 60; Thomas Orme of Ashbourne, husbandman, aged around 38, deposed that when some of the inhabitants were called to London and one was imprisoned in Fleet prison, Sir Thomas bore their costs; Nicholas Hurte of Ashbourne, yeoman, aged around 40; Nicholas Hall of Compton, miller, aged around 34; Henry Orme of Compton, webster, aged around 46; Raphe Mason of Ashbourne, loder, aged around 40; Richard Ashton of Dovebridge, yeoman, aged around 4 score [80 years]; John Bradley of Oker, Staffordshire, yeoman, aged around 4 score [80 years]; Anthony Mosley of Ashbourne, yeoman, aged around 3 score [60 years]; Raphe Smith of Ashbourne, shoemaker, aged around 3 score and 6 [66 years]; Michael Buxstones of Church Mathefelde, aged around 30; Raphe Goodacre of Dunnington, Leicester, aged around 52; Thomas Cooke of Ashbourne, miller, aged around 30; Nicholas Hall of Compton, miller, aged around 40; Robert Street of Ashbourne, fletcher, aged around 3 score [60 years]; Raphe Birch of Ashbourne, cowper, aged around 60; Robert Shotwall of Ashbourne, mercer, aged around 50.

Deponents for defendants: William Wardell of Derby, aged 70 years and more, deposed that he remembers for the past 40 years the inhabitants of Ashbourne have ground their malt at Derby. He can also remember that before William Jackson erected his malt mill in Ashbourne, the inhabitatns used to come in to Derby to grind malt; Roger Hurst of Ashbourne, yeoman, aged around 69, deposed that the inhabitants of Ashbourne have freedom over milling. That there are 50 households in Ashbourne that maintain themselves by baking and brewing, selling their produce in the nearby towns of Buxton, Hartington and Newton Grange. Also 'diverse strange persons' come into Ashbourne to buy baked food and beer at the market. A previous case, 30 years ago [1547] attested to the custom that millers took 1/24th of produce ground at their mill; James Peyron of Ashbourne, blacksmith, aged around 70; William Bagshawe of Ashbourne, shoemaker, aged around 62, deposed that he remembers Sir Thomas Cockaine reading a proclamation on two occasions, having caused the segeant of Ashbourne to call the neighbours together, commanding them not to grind any malt at any mills save their new mills in Ashbourne. However the inhabitants began to grind their malt at Cockayne's mill at Compton until 23 July last. The inhabitants of Ashbourne only now grind their malt at the new mills of Ashbourne as they have been compelled to do so; John Orme of Clifton, cowper, aged around 63; Humphrey Smythe of Compton, badger, aged around 56; John Hall of Ashbourne, sheerman, aged around 73.
