Description

Short title: Broughton v Broadhurst.

Plaintiffs: Edmund Brogstone [Broughton], gent.

Defendants: Humphrey Brodehurst.

Documents: depositions concerning common rights of tenants in Over Haddon, Derbyshire.

Taken 13 August, 19 Eliz.

Deponents for plaintiffs: Thomas Newton of Monyash, husbandman, aged 60, whose memory of the land in question goes back 50 years [to 1527], deposed that he was born in Monyash and all his life had seen the lands called Haddon Haye, Warmebath and Staynlow used by the tenants of Ottaddon for pasture. [Discussed attempts at enclosure]; Martin Fley of Monyash, aged 70, deposed that George Abell has a lease of the land from the Duchy of Lancaster but that he does not know from when or for how much; Hugh Seldon of Monyash, aged 40; William Boam of Monyash, aged 50, born in Monyash; Richard Hodgkinson of Longstone, aged 70, deposed that the defendants and their ancestors and others have always had common on the lands in question to turbary and that there were no stints on the land. George Abell and Edward Broughton have never had lease of the land; John Twigg of Bakewell, aged 60; William Bonsall of Heathcoate, aged 60, whose memory of the lands goes back at least 46 years [to 1531]; Richard Sterndale of Bakewell, aged 40; Nicholas Jowll of Over Haddon, husbandman, aged 66.
