Description

Short title: Barbone v Howe.

Plaintiffs: Thomas Barbone and William Hall.

Defendants: George Howe.

Documents: depositions concerning the division of land called Grynasbrooke in Edale, Derbyshire.

Taken 20 September, 8 Eliz and 11 January, 9 Eliz.

Deponents [for defendant and plaintiff is not indicated] John Hall, aged 59; Thomas Merk, aged 49; William Halle, aged 40; Roger Eyre, aged 36; Robert Hall, aged 35. Raphe Barber of Edale, yeoman, aged 60, whose memory goes back 52 years [to 1514], deposed that he remembers his father telling him about the background to the division of Grynasbrooke. 13 years ago there was a dispute between tenants regarding certain ways of easement which some claimed to have over the grounds. The tenants submitted themselves to arbitrationand all neighbours consented that the everyone 'shuld use his severall waies over the sevall grounds of the other accordinge to suche order as they then appoyntd wch was other wise then before had been used' [should use his several ways over the several grounds of the others according to such order as they then appointed which was otherwise then before had been used]. 9 years ago a similar case of arbitration was initiated by the neighbours between this plaintiff and defendant. It was agreed 1 year ago that the original lease of the farm should be given into the custody of the neutral Edward Barker of Rowley; Thomas Bawgye of Aston, gentleman, aged 60; Oye Barker of Edale, yeoman, aged 51; John Hall of Castleton, husbandman, aged 58; Humphrey Cocke of Woodsetts, husbandman, aged 68.
