Description

Writ of certiorari, with return: proceedings before the lieutenants of the Constable and Marshal, taken under the law of arms, and depositions between William Gerard of London and John Chamberlain of Calais touching the alleged unlawful detention and escape of Hankyn Lower, alleged to be an apprentice of William Gerard, from Calais gaol: Chamberlain appealing; includes bill of costs 19 mm, 2 sch The record of the proceedings in this case is a return to a 'certiorari' issued out of Chancery. It records a hearing before Sir John Cheney, lieutenant of the constable, and Chamberlain's appeal against the sentence. This file has some procedural significance, since it includes bills of costs. The depositions of Hannequin Lower, a Fleming, and effectively the casus belli in the case, makes references to ordinances issued at the time of the crusade of the bishop of Norwich. The case also illustrates the complexity of the law of arms and its application to ransoms. On one reading of the evidence, Hannequin himself had been forced to indent to serve Gerard in lieu of ransom, and was imprisoned for alleged non-completion of the term of service. John Chamberlain, the appellant, claimed that William Gerard had forfeited all his rights in Lower because when he lodged him in the prison at Calais he did not ask permission from the captain's lieutenant, as by law of arms he was bound to do; and that the case was also in breach of the privileges of the burgesses of the town, Latin and French, Ric II
