Henry Smith's Charity, Kensington Estate (1627): Attorney General v. Duke of Northumberland and Others. Application by the Trustees and the "poor kindred" of Smith, as defined by his Will, to vary Scheme settled in 1860. In 1878 all the Charity property was declared to be held first for the "poor kindred" and subject thereto for general charity. New clauses approved of in 1879 limited the amounts to be paid to such "poor kindred" and also the amount to be spent on the education of children of such persons. The Trustees suggested that the surplus funds should be used for making donations to hospitals, and in spite of the opposition of Smith's descendants, a new Scheme on these lines was drawn up and approved.
