Description

Henry Smith's Charity, Hartlepool. Attorney General v. Earl Onslow and Others. In 1881 the Charity Commissioners asked the Attorney General to bring proceedings to vary the Scheme. They wanted to have a clause struck out giving the Trustees leasing powers of an unusual character. The Trustees opposed this, but the clause was struck out by a decision of the Court in November 1881, and on appeal the decision was withheld. On the Question of costs the Trustees were debarred from drawing on the Charity funds.
