Derbyshire lead mines: A.H.Stokes and H.M.Inspector of Mines for the Midland Counties v. F.C.Arkwright. Stokes prosecuted Arkwright for failing to fence in an unused mine to the public danger. A similar case in 1896 in which the Duke of Devonshire was summoned for the same offence is quoted, and the documents attached. Arkwright appealed on the grounds that he was merely the owner of the land and was not a person "interested in the minerals of the mine" as defined by the Metalliferous Mines Regulations Act 1872. The interested party under that definitation was the Duchy of Lancaster.
