West, or Sackville West v. Attorney-General. Petition of Ernest Henri Jean Baptiste Sackville West, son of Lord Sackville, under Legitimacy Declaration Act 1858. Plaintiff claimed to be the legitimate son of Baron Sackville by his marriage with Josepha Dominga Duran, otherwise Josephine Duran de Ortega, sometimes called Pepita Duran, and to be the rightful claimant to the property and title of Baron Sackville. The petition was dismissed with costs on the grounds that Josephine Duran de Ortega was lawfully married to Juan Antonio Gabriel de la Oliva in 1851, and remained his wife de jure until her death in 1871.
