Description

Indenture of a confirmation of a lease between Sir George Shirley of Staunton Harold, Leicestershire, baronet, and Henry Shirley, esquire, son and heir apparent of Sir George Shirley, on the one part, and Sir Edward Underhill of Eatington, Warwickshire, knight, Sir Richard Farmer of Somerton, Oxfordshire, knight, and Sir Basil Brooke of Madeley, Shropshire, knight, on the other part, following a dispute over a lease, dated 28 April 1541, of the manor of Nether Eatington (Etingdon) alias Eatington, Warwickshire [details specified] by Francis Shirley of Staunton Harold, Leicestershire, deceased, grandfather of Sir George Shirley, to Edward Underhill of Eatington, Warwickshire, gentleman, Margaret, his wife, Thomas Underhill, gentleman, son and heir apparent of Edward and Elizabeth, his wife, for the term of 100 years and for annual rent of 40 marks. The dispute, arising from whether the lease was only tenant in tail, was arbitrated by Sir Edward Coke, knight, lord chief justice of England, awarding that the lease stands but the rent is to increase from 40 marks a year to 100 marks. Dorse: witnesses: Thomas Greene, William Underhill, John Barbon, Francis Collyns, Edmund Rawlins and Robert Stickland. Two seals of Sir George Shirley and Henry Shirley.
