John Cunningham, merchant, Joseph Pearson, mariner. v. Anthony Booth, Edward Leech, Thomas Coore, John Whiteside, James Dawson, John Brown, Richard Hewett, John Oldfield, Andrew Moore, Richard Gildart, Robert Tuitte, William Allott, William Clayton, Edward Poole, Peter Hall,"and others.": Charter party entered into between some of the defendants and the plaintiffs for the freight of the brigantine Providence from Liverpool to New York (America), thence to the Leeward Isles, and then to Liverpool, &c., &c."What is the usage and custom of merchants relateing to the fraighting of shipps and vessells for themselves or others their employers. Is it not usuall to allow demurrage and dead fraight, and what is the com'on or usuall allowances, is it according to agreement or according to the bulk or burden of the shipp?" &c., &c.
