James Marsh, "one of the defts.": Contract and articles of agreement entered into by defendant with plaintiff for the sale of "a certain number of trees growing belonging to John Rigby, gent. (in Upholland), and for the plt. to have freeliberty to take, cutt fall, saw, work, carry away, and dispose of the said trees at any time or times within three yeares," "and the deft. to find and procure the complt. full and free liberty by and thro' the lands of Mr Chr Roby, being the most convent way and passable to carry the said trees," &c., &c.
