The Right Honble. Thos. Lord Viscount Fauconberg. v. The mayor, aldermen, and burgesses of the borough of Macclesfield (Chester), Ralph Poole, Wm. Rowe, Thos. Wright, Thos. Lunt, John Houghton, senr., Edwd. Cherry, Richd. Worthington, Willm. Davey, Richd. Burgess, Adam Endon, John Houghton, junr. Nich. Thornly, Phil. Thompson, Josiah Barber, Roger Bancroft, Jonathan Clerk.: Manor, towns, &c., of Macclesfield, Sutton, and the ancient water corn mills situate in "Macclesfield alias Maxfield in Sutton" (for which a fee-farm rent of 7l. is said to have been paid annually to the Crown), alleged to have belonged formerly to Sir Humfrey Davenport, Knt., (Lord Chief Baron of the Court of Exchequer in the reign of Charles the First), and since to James Davenport, late of Sutton, son and heir of said Humfrey, to which James and his wife Ann, the Viscount, the now plaintiff, claims to be grandson and heir. Touching the custom of "suit and service" (i.e., grinding corn &c.) due from the tenants of said manor to said mills.: Stafford; Chester.
