The Right Honble. Thos. Lord Viscount Fauconberg. v. The Mayor, Aldermen, and Burgesses of the Borough of Macclesfield, Ralph Poole, John Houghton, Wm. Rowe, Richd. Worthington, Thos. Lunt, Richd. Burgess, Edwd. Cherry, John Houghton, junr., Wm. Davey, Nich. Thornley, Thos. Wright, Phillip Thompson, Jonn. Clerk, Adam Endon, Josias Barber, Roger Bancroft.: Manor, towns, &c., of Macclesfield and Sutton, and the ancient water corn mills situate in Macclesfield alias Maxfield in Sutton (for which a fee-farm rent of 7l. is said to have been paid annually to the Crown); said to have belonged formerly to Sir Humfrey Davenport, Knt. (Lord Chief Baron of the Court of Exchequer in the reign of Charles the First), and since to his son James Davenport, late of Sutton, son and heir of said Sir Humfrey of which James, and his wife Anne, the now plaintiff claims to be grandson and heir, &c., &c. Touching the custom of "suit and service" (i.e., grinding corn &c.) due from the tenants and others of said manor, &c., to the aforesaid ancient mills.: Chester
