Description

Short title: Godolphin v Ustick.

Plaintiff(s): William Godolphin.

Defendant(s): Richart Ustick, merchant.

Subject of depositions: Town and borough of Penzance (Cornwall), and the mills there called "Tolcarne Mills." Touching the custom of "suit and service" to the mills (i.e. grinding corn, etc.). Also touching an alleged contempt of court committed by defendant in disregarding and disobeying a decree of the Court of Exchequer (dated 12 Chas I Easter) made in the suit of William Godolphin, plaintiff, and William Madderne, mayor of the town of Penzance (Cornwall), Roger Polkinghorne, AnthonyGubbs, William Noseworthy, and others (then aldermen of the town), and Pascow Ellis and others, tenants and inhabitants there, defendants, by which decree it was ordered that the defendants, and all other the tenants, burgesses, and inhabitants of and within the borough, should grind all their corn, grain, and malt at the plaintiff's mills called "Tolcarne Mills" and not elsewhere, except so much of their malt as Tolcarne Mills could not dispatch to be ground at Cornkey Mill in the decree mentioned, and that none of the defendants, nor any other tenant or inhabitant there whatsoever, should thereafter erect or cause to be erected or sett up any querne hand mill, horse mill, or malt mill in or within the boro'. Nor should make any unlawful order or orders or do any other act or acts whatsoever, whereby the suit of mill to the plaintiff's mills should or might be withdrawn, or in prejudice to the plaintiff's mills.
