Description

Short title: Northcott v Smith.

Plaintiff(s): Richard Northcott, William Green, John Temple, Leonard Hasely.

Defendant(s): Sir Sebastian Smith, kt, Robert Whorwood, Richard Day, Gilbert Jackson, John Glover, Thomas Symes, William Mathews.

Subject of depositions: "Disafforestation" and enclosing of the forests of Shotover and Stowood (Oxfordshire). Touching the interest or usage and enjoyment of common in the forest of the cotagers and of the landholders, and the allotment of common or lands for common for the town of Whately. Also touching the respective rights and customs of commoning of the landholders and of the poor cottagers of Whately before the inclosure, and a former suit in the Exchequer between the Attorney General, plaintiff, v. Crecheild Draper, Robert Whorwood, Gilbert Jackson, and John Robinson, and a decree of the Court of Exchequer therein, and an alleged agreement come to between the landholders and cottagers. Also touching the bounding and fencing of the respective allotments of the landholders and cottagers and poor inhabitants of Whately aforesaid.
