Description

Short title: Bishop of Durham v Wharton.

Plaintiff(s): The Right Revd Father in God Nathaniel Lord Bishop of Durham.

Defendant(s): Humphrey Wharton, esq, Anthony Wharton, gent.

Subject of depositions: "Lead mines and groves of and belonging to the defendant within the parishes of Stanhopp and Wolsingham, granted to defendant by John late Lord Bishop of Durham. Whether said John reserved to himself and his successors the lott or nyneth part of all lead oare to be dugg or gotten in the said mynes within the said parishes, clean and well washed, without any deducc'ons for any manner of charges for the winning, getting, or working?" etc. Cost of working the mines. Workmen's wages. Amount of lead ore wrought by defendants (partners) from February 12, 1676, till February 1684. Touching an agreement between the Marquesse of Winchester and the defendants, and what proportion of the lott or ninth part is mentioned in the agreement to be paid by the partners under the agreement? Whether defendant Humphrey procured a lease or grant of the lott or ninth part from John late Bishop under the rent of 60l.? Under what names the lease was obtained? Whether obtained by surprise, and at his first entry into the "sea" of Durham "before he was duly informed of the true value of the p'misses "? Touching the yearly value of the "part of said mines called the ninth lott and tenth." Alleged threats made by defendants to persons appointed by plaintiff to take an account of the quantities of lead ore wrought.
