Subject of depositions: Undertaking entered into by the plaintiff (under bond or penalty) by order of the Lords of the Counsel of Scotland to convey persons (prisoners) sentenced under the laws of Scotland to transportation into some of His Majesty's plantations, and an agreement made by plaintiff with the defendant to bring such persons by the ship St Michael, of Scarboro', into the river of Thames. Touching the defendant's non-fulfilment of his part of the contract by allowing some of the persons to escape, thereby causing the detention of plaintiff's solicitor in a Scotch prison, to the great expense and injury of plaintiff.
