Plaintiff(s): Robert Tempest, Thomas Ledgard, Leonard Shafto (an infant), by Sarah Shaftoe, his guardian and next friend.
Defendant(s): Sir Ralph Jenison, kt, Lancelot Newton, William Wallis alias Wallas, Francis Bowes.
Subject of depositions: Manor of Elswicke (Northumberland), and the collyeryes and colemynes within the manor. Touching a bargain and sale of the premises, together with sufficient "wayleave" and "staithleave" and liberty to digg pitts therein, made from Edward Ditchfield, John Highlord, Humfrey Clarke, and Francis Mosse, to Sir William Hewitt and Thomas Hewitt, son and heir of Sir William and a conveyance of the premises from Sir William Hewitt and Thomas Hewitt to Sir Nicholas Tempest, of the town of Newcastle-upon-Tyne, knight, and Leonard Carr, of that town, merchant, and a conveyance of same premises made from Sir William Hewitt and Thomas Hewitt to Chas. Tempest, of that town, merchant, and Mark Errington, of Howden Head (Northumberland). Whether the owners of those collyeryes and colemynes did ever make any payment, recompence, or satisfaction to any of the owners of the lands, within the manor for digging and sinking pitts within the manor, or for way leave with their carts and carriages for leading the coles wrought out of the pitts through the lands within the manor, or for staith rooms to lay coles wrought out of the manor and collyery upon; and when was the first time that any recompence or satisfaction was demanded for such way leave, staith roome, digging and sinking pitt or pitts, or laying the rubbish or refuse upon the lands or grounds; and had the owners and farmers of such lands within the manor the sole leading of coles wrought and gott within the lands? etc. Customs of manor. Rent paid to the Crown for such colemynes.
