Description

Short title: Attorney General v Horsfall.

Plaintiff(s): Attorney General and William Jervis.

Defendant(s): John Horsfall, William Sedgswick, Robert Sedgswick alias Sigiswick, John Dothewite.

Subject of depositions: Manor or capital messuage of Newsam alias Newsholme and Westholme (Durham); whether bequeathed by the last will and testament of Henry, late Earl of Westmorland, unto his daughter Margaret Watson alias Nevill, for 41 years, to commence after two former leases made to John Cholmeley, of Newsame, and John Dowthwaite, of Westholme, and whether conveyed by Margaret and Francis Cross her husband to plaintiff for the expiration of such 41 years. Copies of grants [on paper], by Robert de Swilington, of the manor of Newsam, to Thomas Trusbut and Heloisa his wife, dated 21 Edw I. Copy of lease, by Ralph Earl of Westmorland to John Wherton, of all his lands, in Newsom and Winston, in the bishopric of Durham, dated 8 Dec 18 Edw IV. Copy of grant by Petronilla late wife of Robert Trusbut, kt, to John de Nevill, kt, Lord of Raby, of said manor of Newsom, near Raby, in said bishoprick, dated London, 5 May, 45 Edw III. Warrant of attorney from Robert Trusbut, kt, to John de Raby, clerk (his bailiff and attorney), to deliver the lands to Ralph de Nevill, Lord of Raby, dated 1359. Copy of grant by William, the son of Everard de Gisburn to Lord Robert son of "Meld'" of all his claim to the lands which his uncle "Roger' le Messag'" lately held in the town of Newsom (no date). Grant by Godric de Newsam and Isabel his wife, to William Trusbutt, of the manor of Newsam, near Cletlum, dated 1348; and a lease by Henry Earl of Westmorland, to John Cholmeley, of Rokesby, within Pickeringliff (Yorkshire), of the grange of Newsam, and a close there called "Bellame Close" and a grant of the manor of Newsam from William de Swillington to Thomas Trusbut and Heloisa his wife, dated 27 Edw I. [William Hedlam, Johan his daughter, married to Ralph Bowes, Charles, late Earl of Westmorland (attainted of high treason, 12 Eliz), are mentioned].

Date of commission: 14 November 1599 and 11 February 1600.
