Description

Petition concerning the advowson of the church of Long Itchington (Warwickshire).

Petition to Sir John de Clinton from John de Peyto, claiming that if William de Peyto and his son are able to deny that they have maintained an unlawful action against the prior of Maxstoke (Warwickshire), in that they and others with their assent brought unlawful machinations and conspiracies upon the people of the county of Warwickshire, then they may have recovery of £40. Further petition that since John de Oddingeseles, who held the manor of Itchington in chief, has made divers suits against the prior and house of Maxstoke, which had been taken into his protection by Clinton by charter, suits which appear by record to be pretended, as Oddingeseles' grandfather had sold four [...] of land and the advowson of the church of Long Itchington by charter of licence and by fine to Hugh de Meryngton', whereafter the grandfather gave all his lands and the advowson to Sir Ralph Bygot to be held from the grandfather and his wife, and Hugh then brought a writ against him for which the grandfather expended much to deny Hugh, and after the grandfather's death Hugh's son and heir sold the land and advowson to Lord Clinton, since earl of Huntingdon, which land and advowson had been appropriated by the priory, upon which Sir John brought his writ against the prior and convent of Maxstoke that Ralph Bygot had given the land and advowson to the grandfather in the manner supposed in the writ, which writ he then waived in favour of another to the effect that Sir John Hastang had given everything to the grandfather, his wife and heirs, and prays that Sir John and the council of the priory may understand that since it is openly known that the grandfather had married the daughter of Sir John Hastang, that Sir Ralph had entailed the manor of Itchington by charter of licence, and that Hastang entailed the lands and advowson upon the grandfather and his wife, Hastang's daughter, without showing licence for this, it appears to all men that the suit is deceitful not least because William de Peyto caused an inquest to take place at Coventry against the king that he who had made fine in £10 in Chancery to give certain lands had never been seised of lands for which he ought to have made fine, and that William had brought an assize against the master of Waleshale, during which his agents menaced the master to give them 1000 marks.
