The EEC Convention published in 1973 applies to practically all forms of compulsory insolvency, its aim being to avoid the confusion and injustice which often arose in the event of a person being declared bankrupt in more than one State at a time, and to secure uniformity in the administration of bankruptcies in member States.

The Committee was established by the Department of Trade and Industry in July 1973 to consider the terms of the preliminary draft of the Convention and its implications for the UK. It consisted of six members and six co-opted members, representing legal and accounting interests; its Chairman was Sir Kenneth Cork.

Due to the wide scope of the Convention, the Committee attached particular importance to the process of consultation, and as a result, a consultative paper was issued in November 1974 inviting comments on the various articles of the Convention from professional organisations, Government departments, employers' associations and other interested bodies.

The Committee's report was published in January 1976 entitled Report of the Advisory Committee on the EEC Preliminary Draft Convention on Bankruptcy, Winding-Up, Arrangements, Compositions and Similar Proceedings.
