Description

Folios 154-155: T[homas] M[outray] Waller, New Romney. Asks that the enclosed memorial be laid before the Admiralty, is seeking relief from the person who is prosecuting him, the lawsuit may be injurious to the Service.

Folios 156-157: enclosure with folios 154-155. The memorial of T[homas] M[outray] Waller, New Romney, formerly Captain of HMS Emerald to the Admiralty dated February 4 1805. George Mingo, formerly a seaman in Emerald, asked to be discharged while the ship was at Syracuse in Sicily, he refused but Mingo obtained leave to go ashore and did not return, after the ship left Syracuse he ordered an"R" to be marked against Mingo's name, as he had deserted, and then notified the Navy Board. When he returned to England two years later Mingo came to him in London and asked him to have the"R" removed so he could receive his pay and prize money, said he had no intention of deserting, Captain Waller at first refused to do this but later wrote to the Navy Board asking for the"R" to be taken off. The Board refused as he had not returned to any of His Majesty's ships. Mingo has now started a lawsuit against him to recover his pay and prize money, he considers that he was only doing his duty, he asks to be releived of the lawsuit and that the Lords of the Admiralty should interpose themselves in the affair.
