Captured ship: Elm Tree (commander Otto van Haecken, otherwise van Aeken, van Aken).
History: a Dutch privateer (frigate or hooker, 8-10 guns, 70-90 men) taken about 7/17 September 1672 off Flamborough Head by HMS Newcastle ([John] Pearce commanding), with the assistance of the hired HMS Levant Merchant (William Hobbs commanding), whilst both were part of the escort of a convoy from the Nore to Newcastle and Leith, and brought first into Leith on or before 18/28 September 1672, and later into London.
Allegation, 15 November 1672, in Pearce v The Elm Tree Otto van Aecken commanding), taken by HMS Newcastle (John Pierce [otherwise Pearce] commanding) and afterwards brought into London.
