Folios 201-202: Clotworthy Upton, HMS Junon, Quebec. Reports that on the 25 September 1814 having observed a Blue Ensign flying on board a Merchant built vessel (which was stated to me, as one which had recently beaten off a privateer). I directed a Midshipman to go on board & acquaint her Master"that as his ship had so gallantly defended her colour, I would not insist on their being immediately hauled down, but after they were so, at sunset hew must not raise them again." On his return the Midshipman informed me he had delivered my order, and that there was a Lieutenant Agent of Transport on board, her name the Harriott & Master name Moore. The next day the colours were again raised, he sent Lieutenant Phis to investigate and bring the colours back. [Mentions Lieutenant Edward P Tregustha (Agent of Transports), Captain Francis Kempt? Statement to Clotworthy Upton about the flying of a Blue Ensign and the rules of the Transports Board with a request to forward them to the Navy Board for a decision.
