Description

Folios 237-238: Nicholas Tomlinson, Flushing, Walcheren. Reports his exclusion from sitting as a Member on a court martial, Captain Lawford was the President and requests adjudication by the Admiralty on whether he should have sat or not.

Folios 239-240: enclosure with folios 237-238. Devon and Tooke, 10 Grays Inn Square, 22 November 1809. Encloses a letter from Captain Nicholas Tomlinson and associated papers on the case and requests a response is sent to their Chambers.

Folios 241: enclosure with folios 237-238. Admiralty Records Office slip noting the return to the Solicitor of Captain Nicholas Tomlinson's request to sit as a member of a court martial on 23 November 1809.

Folios 242-246C: enclosure with folios 237-238. Outlines the case for Captain Nicholas Tomlinson not sitting as a Member on a court martial and whether the result of the court martial is legal without his input on the case. Captain John Lawford was the President at the time and Captain Nicholson was not allowed to sit as he was not on a list of Captains in command of a specific ship at the time.
