Description

Folios 230-231: Andrew Smith, Greenock. He refers to the enclosures which is the opinion of the decision of the Lord Ordinary and the Water Bailie who have ordered the release of an impressed man.

Folios 232-235: enclosure with folios 230-231. 4 pages setting out a review written by Mr Alexander Colquhoun of the opinion of the Lord Advocate which deals with an impressed man named Alexander Henderson. An application for his release had been made by his employers on the grounds he was the mate on their vessel the Jessie and therefore could not be impressed despite the fact that he was on shore and drunk when impressed. The Water Bailie ordered his release and Captain Smith observed that once this order has been made there is nothing more to be done and generally the Water Bailie releases every man impressed. Furthermore the order was upheld by the Lord Craigie the Lord Ordinary. Captain Smith has observed that this case is of importance given the precedent that it sets and suggests the Admiralty refers it to the Lord Advocate for advice. Further more he suggests the Admiralty consider whether the Water Baillie of the Clyde is competent or whether an investigation whould be ordered into his conduct ahd jurisdiction. The note concludes with the advice of mr Colquhoun that the present case should not be used as a test case.
