Folios 199-200: Wilson Rathborne, North Shields. Responding to Mr Barrow's query of 18 February, on the case of Thomas Gardiner, now aboard the Ceres, and returning enclosures and protection. Says Gardiner, alias Fenwick, was impressed by Lieut. Liddle, Sunderland, on 19 January as a deserter from the Serwin [?]. He entered as a substitute for keelmen on the Wear, in 1809, and deserted the same year. When impressed he was recognised by two people including the midshipman and known to sometimes use the name Fenwick. He is 24 and fit for service.
Folio 201: enclosure with folios 199-200. Signed statement dated 15 February 1812 from the Custom House at Whitby that Gardiner, Line Manager of the Volunteer, engaged in the Greenland Whale Fishery, had made the necessary commitments and been given the consequent certificate of protection.
Folio 202: enclosure with folios 199-200. Official protection for Thomas Gardiner, signed at Whitby on 28 August 1811, as Line Manager of the Volunteer, Master John Dawson for the following season, and is not to be impressed from the ship.
Folios 203-204: enclosure with folios 199-200. Letter dated 15 February 1812 by Richard [?] owner of the Volunteer, stating that Gardiner has been impressed but that he is sending a letter from the man giving the cause of the impress, and a certificate from the Whitby custom house confirming his protection. Adds that Gardiner had made 2 voyages in the William & Ann but has now been with the Volunteer for 3 years is is known to him only by the name of Gardiner and as he has been illegally impressed he should be discharged.
Folios 205-206: enclosure with folios 199-200. Letter dated 10 February 1812 by Thomas Gardiner, aboard HMS Ceres, saying he had been impressed by George Swiney, Midshipman, and produced his protection but Swiney had stated he was actually named Fenwick, in consequence of which he was sent to the Ceres. Says Fenwick is his father-in-law's name. Says he had left the William & Ann, Captain Stephens, 'with a good character', to join the Volunteer.
