Description

Folios 206-207: Wilson Rathborne, Regulating Captain, North Shields. Responds to the letter of 5 October and sends a report on the case of John Tate, currently on board the tender HMS Lyra. Returns the enclosure with the Affidavit of Tate as Mate. John Tate, Able Seaman, was pressed by Lieutenant Flinn, North Shields on 23 September and detained as it appeared that the Owner, George Hutchinson, was sailing in the vessel in addition to the Master. The Master acknowledged that the Owner had sailed in the vessel and he is described as a Mariner on the Register. John Tate is 22 years old, has been at sea for 7 years, and is a stout healthy man well suited for service.

Folios 208-209: enclosure with folios 206-207. Letter dated 1 October 1811 from Jonathon Cockerill, South Shields, to The Admiralty. He encloses Affidavits from Philip Brown and George Hutchinson, the Master and the Owner of the ship Bilboa, regarding the pressing of John Tate, the Chief Mate of the vessel. Mr Hutchinson was in the vessel during a voyage to London and back to Shields, but he was not involved in sailing her. The same number of men and boys were employed as if he had not been on board. John Tate was the bona fide Mate and was pressed in the River Tyne after Hutchinson had left the vessel. Applies for Tate's discharge, as the Owner was not present when the Mate was pressed. His Protection was then valid

Folio 210: enclosure with folios 208-209. Affidavit dated 1 October 1811 by Philip Brown, of South Shields, sworn before Jonathon Cockerill, Master Extraordinary in Chancery, North Shields. He is Master of the ship Bilboa of Newcastle, appointed 10 September 1810. On appointment he made the usual Affidavit for the protection of John Tate, Chief Mate of the vessel. John Tate was not at the time an Apprentice. On the last voyage to London with a cargo of coal, the Owner George Hutchinson was on board. They had nine men and boys on board, which was the usual complement. George Hutchinson did not take part in the sailing . On arrival in the River Tyne on 23 September George Hutchinson went ashore and John Tate was pressed while on board and carrying out his duties.

Folio 211: enclosure with folios 208-209. Affidavit dated 1 October 1811 by George Hutchinson, of North Shields, sworn before Jonathon Cockerill, Master Extraordinary in Chancery, North Shields. He is owner of the ship Bilboa of Newcastle. On 26 August he sailed in the vessel to London and back to Shields. Thomas Smith was the legal Master and John Tate the Chief Mate. George Hutchinson did not carry out any duties during the voyage. John Tate has served his Apprenticeship which had expired before the voyage. Philip Brown succeeded Thomas Smith as Master, and gave the necessary Protection to John Tate as Chief Mate.
