Description

Folios 162-163: Thomas Flinn on behalf of Captain Rathborne, Regulating Office, North Shields. Responding to the letter of 19 September with a report on the case of John Bailey, currently on board the Lyra tender. He returns the enclosures, with the Affidavit and Protection taken from him when pressed. John Bailey, and Ordinary Seaman, was pressed by Lieutenant Lapslie, South Shields, on 12 September and detained until a decision is made on his case, as he believed that the Indenture was still valid because the Apprentice's signature was not present on the endorsement on the back. Lieutenant Lapslie deems the endorsement illegal and requests a decision. John Bailey is 21 years old, has been at sea for more than 3 years, and is a healthy young man well suited for service.

Folios 164-165: enclosure with folios 162-163. Letter dated 16 September 1811 from William Harrison, Dockwray Square, North Shields, to The Admiralty. He is writing on behalf of Mr Ralph Richardson, Owner of the ship Nestor, of North Shields, and sends documents relating to John Bailey, Mate of the ship, who was pressed at South Shields whilst actually serving as Mate on board the ship. It appears from the enclosed Affidavit of David Smith, the Master, that he had previously been an indentured Apprentice for 4 years but his Owner, Mr Richardson, thinking highly of his abilities as a Seaman, cancelled his Indenture by endorsement dated 12 August 1811. He then became Mate of the Nestor. Asks that the papers are considered, and points out the importance of having the Mate on board the ship, in case there is an accident to the Master. Requests John Bailey's discharge.

Folios 166-167: enclosure with folios 164-165. Protection dated 19 September 1808 in the name of John Bailey, Apprenticed to Ralph Richardson on 5 September 1808 for 3 years.

Folios 168-169: enclosure with folios 164-165. Affidavit dated 16 September 1811 sworn by David Smith of North Shields before William Richardson, Public Notary, North Shields. Gives a description of the pressing of John Bailey, the Mate of the Nestor, of which he is Master, while John Bailey was on board and before they reached dock. There is no other Mate on board. John Bailey served an Apprenticeship with Ralph Richardson, the Owner, and after 3 years had expired this was terminated by mutual consent, and before he became Mate.

Folios 170-171: enclosure with folios 164-165. Statement dated 16 September 1811 by John Bailey, of North Shields, Mate of the Nestor. He declares that he served 3 years at sea as an Apprentice to Ralph Richardson, Owner of the Nestor, and requested that this was cancelled when he reached the age of 21. He was then promoted to be Mate of the ship. He performed his duties as Mate for one voyage in the coal trade and was then pressed when on board the ship.
