Folios 430-431: Robert Rolles, Sea Fencibles, Hastings. Replies to letter and enclosures of 9 [January 1809]. When he was Captain of HMS Lion, Mr Daly was repeatedly insubordinate to his superior Officers and challenged the 2nd Lieutenant on the quarter deck. He thought it necessary to dismiss him. On arrival in England he received notice that an action was to be brought against himself and Mr Daly in a civil court . He appointed the Admiralty solicitor to endeavour to settle it, but his agent, Mr Knight, said that the only terms would be for him to make an apology to Mr Daly, which he could not do. He had to defend the case in court, and had his character publicly aspersed by the instructions of Mr Daly. He had no personal concern in the disputes between Mr Daly and the principal Officers. Had he at any time before the trial appeared disposed to do what was proper he would have been inclined to listen to him, but in the present state of the case he hopes they will excuse him not thinking that Mr Daly is entitled to any favour from him.
