Folios 398-399: John Tremayne Rodd, HMS Indefatigable, at anchor off Gijon. Encloses a copy of a letter to Lord Gambier and one to the Mayor of Gijon claiming an English transport.
Folios 400-401: enclosure with folios 398-399. Letter dated 17 June 1809 from John Tremayne Rodd, HMS Indefatigable, Gijon Roads, to Lord Gambier, Admiral of the Blue, Commander in Chief. On his arrival there yesterday he found that the French had evacuated Gijon and about 2000 Spanish troops are there. He found the English transport, HMS Tiger, which had been sold by the Mayor of Gijon and was going to Bayone with a cargo. He has claimed her and after much trouble they have given her up. He has ordered Lieutenant Swain of HMS Attack to convey her to Plymouth. He has ordered the stores which are chiefly medicines to be given up to the Spanish Lieutenant General Don Jose Voster Servert. As reported previously he did not find out that the French had evacuated Gijon for several days because the signals were not answered by Gijon otherwise he would have been able to prevent several barges getting away with plunder.

Encloses a copy of a letter sent to the Mayor of Gijon demanding the immediate restoration of an English transport which he had sold, as a result of which the brig has been restored.

Folios 406-407: enclosure with folios 398-399. Copy of letter dated 17 June 1809 from John Tremayne Rodd, HMS Indefatigable, Gijon Roads, to the Mayor or Municipal Officer at Gijon. He was told a transport belonging to His Britannic Majesty in th pier at Gijon, left there when the French entered the place, loaded with army stores intended for the use of the Spanish troops who are engaged in a just war in support of Ferdinand the Seventh. he has unjustly sold it and allowed the stores to be plundered. Claims restoration of the transport and the stores which it was his duty as a faithful ally to have done as son=on as the enemy retreated. Also accuses him of refusing to allow the signals to be answered so that for several days he did not know that the French had retreated. This allowed the enemy to get round to their ports with stores from Gijon which he could probably have prevented. Accuses him of being an enemy to the cause of Ferdinand the Seventh and to great Britain which has been giving him every assistance. he will inform the British Government, the Supreme Junta and the Marquis de la Ramana about his conduct. If the stores are not all collected and the transport restored immediately he will look upon him as an enemy and act accordingly. He gives hi 2 hours to reply to his demand.
