First party: Hawise de Quyncy [Quincy], countess of Lincoln.
Second party: Philip de Kyma [Kyme].
Place or subject: A dispute was moved between them concerning a certain obstruction of a watercourse made by Philip in Torp to the nuisance of Hawise's port of Weynfled [Wainfleet]. Because it was then clear that the land of both sides of that watercourse towards the port of Wainfleet belongs to Philip, the lordship of that ditch where that water runs remains to him and his heirs in this manner: namely that the course of that water towards the port of Wainfleet ought to be open and without obstruction every year from Michaelmas to Easter then following, and from Easter throughout the three weeks next following Philip and his heirs, by this covenant, can and ought to obstruct the course of that water every year to refresh the ditches of his manor of Croft and to water his beasts. Immediately once those three weeks have elapsed, Philip and his heirs will completely remove the obstruction, in such a way that throughout another three weeks next following, Hawise and her heirs can have the course of that water completely open as far as her port of Wainfleet, and thus every single year between Easter and Michaelmas next following throughout three weeks the course of that water will be obstructed and throughout another three weeks following is open. Immediately next after Michaelmas Philip and his heirs every single year are to open the watercourse and it will remain open every single year until Easter next following. This agreement was enrolled in the rolls of Robert de Lexsinton [Laxton], Jollan de Neville, Robert de la Haye and Warner Engayne, itinerant justices of the king at Lincoln.
