Folio: 180v. Hampshire. Obligation.
First party: William Mauduit, lord of Weremenistre [Warminster].
Second party: Patrick de Chaworc' [Chaworth].
Place or subject: William is bound to acquit Patrick of eighteen marks, for which Patrick is William's pledge. And towards full payment of which, if William makes default, by Patrick's deed of obligation for William, at the distraint of the sheriff of Wiltshire for the time being, he bound himself, his lands and goods, moveable and immoveable, both against Elias Totele for eleven marks of good and new money, namely at the feast of St John the Baptist [24 June] 1249 for six marks, and at Michaelmas next following for five marks, and against Lawrence son of Robert at Michaelmas of the same year for seven marks of good and new money. And towards doing this, William binds himself and his heirs, his lands and all his goods, moveable and immoveable, wherever they will be found in Wiltshire and Hampshire, to the distraints and controls of the sheriffs of Wiltshire and Hampshire for the time being, in acquittance of that plevy of this sum in any term, that they can distrain William and his heirs towards the acquittance of that plevy and the payment of this money, and to the use of the king in the name of an amercement by such agreement, if he does not acquit at that term Patrick de Chaur' of that plevy, to receive £10 sterling from William or his heirs. If he has any damages or makes any expenses by reason of that plevy, William grants for himself and his heirs that it is to be paid to him fully, in such a way that neither William nor his heirs are to have any power in the lands, rents or goods or the issues of the lands from those sheriffs of Wiltshire and Hampshire for the time being able to have entry in his lands in Wiltshire and Hampshire and to hold them in their hands until he has acquitted Patrick of that plevy, damages and expenses, and they receive that £10 to the use of the king. William and his heirs are not to have any power to make a will, and their executors are not to execute anything, until they have acquitted Patrick of that plevy, and have made satisfaction for those damages and expenses, and also satisfied the king of that £10.
County: Hampshire; Wiltshire.
Additional people: Witnesses: John Mautravers [Maltravers]; Alexander de Cheverel; Simon Cheverel, his brother, Lawrence son of Robert; and Ivo de Furtune.
