Description

Folios: 146-146v. Bedfordshire. Writ.

First party: Edward II.

Second party: John Waleweyn [Walwayn], escheator this side of the Trent.

Place or subject: Writ of Edward II, directed to Master John Waleweyn, his escheator this side of the Trent, in the tenth year of his reign. Nicholas le Latymer [Latimer] has shown to the king that, whereas John de Kynardeseye, clerk, lately by the king's licence had given and granted the manor of Sutton with the hamlets of Potton, Holm [Holme] and Stratton, Beds, which he held of the king in chief, to Alice Latymer. To hold to Alice for the whole of her life of the king and his heirs by the services due and accustomed. After her death, the manor is to remain to Nicholas and his heirs in tail, to hold of the king and his heirs by those services. If Nicholas dies without heirs in tail, then after the deaths of both Alice and Nicholas the manor is to remain to Thomas, earl of Lancaster, the king's kinsman. Although after the death of Alice, Nicholas entered that manor by virtue of this feoffment, the escheator, asserting that Alice had been seised thereof in her demesne as of fee on the day she died, ejected Nicholas from the manor and took it into the king's hands, and still detains that, to his great damage and harm. Therefore, he has entreated the king for a remedy. The king wishes to be made more certain as to whether Alice held that manor for the term of her life only or in fee, and how and in what way, and if that manor ought to remain to Nicholas or to anyone else, etc, after her death, and by what service, etc. The king commands the escheator to inqure dligently by the oath of upright and lawful men from his bailiwick as to the truth of the matter.
