First party: Edmund, son of Henry III [Edmund of Lancaster].
Second party: John de Swinnerton [Swynnerton], knight.
Place or subject: Whereas a dispute has arisen between Edmund and John concerning the right and ownership of the whole wasteland called le Shortelime and Weure, which Edmund claimed to be his as of the appurtenances of his manor of Newcastle under Lyme, and John claimed to be his as appurtenances of his manor of Swinnerton [Swynnerton], the dispute has been settled in a friendly and agreeable manner by division of the land made between them. John has granted and acknowledged the moiety of the whole of that land, which is nearer to Edmund's land of his manor of Newcastle, to be Edmund's right of as that which ought to pertain lawfully to his manor of Newcastle. John also granted and delivered to Edmund from John's share in the same waste two acres and one rood of land, on account that the land of Edmund's share is poorer than that of John's share, according to the estimation of upright and lawful men in partition of the land. In addition to this, granted and delivered to Edmund from John's share one half-acre of land and 4s of annual rent to be received from thirteen freemen of Boterton [Butterton], holding twelve acres of land of that waste, in recompense for five acres of land, which Edmund gave to the master and brethren of the Knights Templar in England from their demesne out of the waste, and in recompense for 2s of annual rent which Edmund quitclaimed from his assessed rent to the freemen of Butterton for releasing the right of the master, brethren and freemen, which they had or ought to exact or have in the common pasture of those wastes forever. John also granted and delivered to Edmund from his share there two acres of land in recompense for four acres of land which Edmund gave to the prior and convent of Stanes [Stone] from his demesne out of the waste for releasing the same common in those wastelands forever, just as is more fully contained in the deeds of the master, brethren and freemen of Butterton and prior and convent of Stone drawn up concerning this. To hold to Edmund and his heirs of his chief lords as of the appurtenances of his manor of Newcastle [Newcastle under Lyme] forever. It will be lawful for Edmund or his heirs or others, to whom they wish to grant that land, to assart that land and plough it and make a meadow thereof, and assess, rent, enclose or appropriate it in any way, and whenever they wish, at their will without any opposition or impediment from John or his heirs or their men or tenants. Saving that John and his heirs and their men and tenants are to have common of pasture for all kinds of their beasts in those lands in the open time after the corn and hay has been carried away in allplaces, except the messuages to be built and enclosed in those lands by Edmund and his heirs or their men or tenants, when they wish to build or enclose them. For this grant and acknowledgement, Edmund granted and acknowledged the whole of that moiety of the wasteland which is nearer to John's manor of Swinnerton [Swynnerton], except for those four acres and three roods of land, according to the abovesaid bounds, to be the right of John, pertaining to his manor of Swynnerton, and he quitclaimed that to John and his heirs forever, saving the common of pasture of Edmund and his heirs and his men and tenants in the open time.
