Description

Folios: 86v-87v. Staffordshire. Settlement of a dispute.

First party: Edmund, son of Henry III [Edmund of Lancaster], and John de Swinerton [Swynnerton], knight.

Second party: Roger, prior of Stanes [Stone], and the convent there, and their men and tenants of Sheperuge and Botertun [Butterton].

Place or subject: Whereas a dispute arose between Edmund and John on the one part and the prior and convent on the other part concerning certain common of pasture which the prior, convent, their men and tenants were exacting for all their beasts at all times of the year in certain pasture called le Shortelime, and upon certain common of pasture which they were likewise exacting in certain land and pasture of Thomas de Stuche in Botertun [Butterton], which lies between the arable field of Butterton and le Shortelime, the dispute came to a settlement, as follows: the prior and convent quitclaimed to Edmund, John and Thomas and their heirs and also their men and tenants the ownership of the ground and common of pasture, which they had lawfully and de facto, and were exacting or could exact in any way in that land and pasture of Shortelime and in the land and pasture of Butterton with appurtenances next adjacent, or also in any other wastes and lands, assarted, rented or in another way appropriated before the completion of the present deed within Edmund's manor of Newcastle upon Lyme, the manor of John de Svinnerton [Swynnerton] and the vill of Thomas de Boterton, except in open time after the corn and hay has been carried away. The prior and convent granted that Edmund and John and their heirs and men and their tenants can assart the land of Schortelime and Boterton [Butterton], whenever they wish, plough or make a meadow thereof, and assess and rent it at their will without any opposition or impediment or right of reclaim of the prior and convent or their successors. Saving that the prior and convent and their successors and their men and tenants are to have in those lands their common pastures for all kinds of their beasts in the open time after the corn and hay has been carried away in all the places where they were previously accustomed and ought to have common, except for messuages to be built in those lands or enclosed by Edmund, John and Thomas or their heirs or tenants, when they wish to build or enclose them. Edmund and John also quitclaimed to the prior and convent and their successors and their men and tenants the ownership of the ground and common of pasture, which they had or could have de facto or lawfully in those four acres of land by the perch of 24 feet in the assart which Richard de Bromleye formerly took from Edmund, lying between Richard's land and the land which William le Cutiler holds of the new castle on the other, and they extend on one side upon the old assart of Sheprug' and upon the new assart of Thomas the forester of the new castle on the other side, or in other wastelands of the pror and convent, assarted, assessed or appropriated before the completion of the present deed, or to be assarted or appropriated from henceforth in Sheperuge and Butterton, except in open time after the corn and hay has been carried away.
