Description

Folios: 37v-38. Lincolnshire. Final concord.

First party: John, duke of Lancaster [John of Gaunt], and Blanche, his wife.

Second party: William de Monte Acuto [Montagu], earl of Salisbury.

Place or subject: £200 of rent with appurtenances in Mertok [Martock]. Whereupon a plea of covenant was summoned between them in the same court. Namely, that the earl granted that rent to the duke and Blanche, to have and receive every single year from all the lands and tenements of the earl in Martock, which are held of the king in chief, to the duke and Blanche and her heirs Blanche forever, on the following condition, namely in the case in which the duke and Blanche and their heirs or assigns are to hold the manors of Troubrigg [Trowbridge] and Aldeburn [Aldbourne] peacefully, without that that these manors or any parcel thereof are to be recovered out of the possession of the duke and Blanche, their heirs or assigns at the suit of the earl or his heirs by plea, the payment of this rent is to completely cease and it is not to be exacted or levied. And in the case in which the earl or his heirs recover those manors or any parcel thereof against the duke and Blanche, their heirs or assigns by judgement, then the £200 of rent with appurtenances are to be paid to the duke and Blanche and her heirs from the time of the recovery every single year at Michaelmas and Easter in equal portions, and then it will be lawful for the duke and Blanche and her heirs to distrain in those lands and tenements of Martock, into whosoever's hands they pass, for that rent, whenever it will be in arrears, and to retain the distraints until satisfaction is made to them of the amount of rent being in arrears from the time of the recovery. For this fine and concord the duke and Blanche gave to the earl £1,000 sterling. This concord was made by order of the king.
