Description

Folios: 37-37v. Lincolnshire. Grant of licence.

First party: Edward III.

Second party: William de Monte Acuto [Montagu], earl of Salisbury.

Place or subject: Licence for the earl that he can give and grant £200 of rent in Mertok [Martock], Som, to the king's son John, duke of Lancaster, and Blanche his wife. To have and receive every single year from all the lands and tenements of the earl in Mertok [Martock], which are held of the king in chief. [To hold] to the duke and Blanche and her heirs forever under the following condition, namely in the case in which the duke and Blanche and their heirs or assigns are to hold the manors of Troubrigg [Trowbridge] and Aldeburn [Aldbourne] peacefully, without the manors or any parcel thereof being recovered out of the possession of the duke and Blanche their heirs or assigns, at the suit of the earl or his heirs by plea, the payment of the rent is to completely cease, and the rent is not to be exacted or levied. And in the case in which the earl or his heirs recover those manors or any parcel thereof against the duke and Blanche, their heirs or assigns, by judgement, then the £200 of rent are to be paid to the duke and Blanche and her heirs from the time of therecovery every single year at Michaelmas and Easter by equal portions, and then it will be lawful for the duke and Blanche and her heirs to distrain in those lands and tenements of Mertok [Martock], into the hands of whomsoever they pass, for that rent, whenever it will then be in arrears, and to retain the distraints until they will be fully satisfied of that rent from the time of the recovery being in arrears. And [licence] for the duke and Blanche that they can receive the £200 of rent from the earl and hold it to themselves and the heirs of Blanche, as is aforesaid, forever.
