Description

Folios: 17-17v. Derby; Ferrers. Letter of Robert de Ferrers made to his mainpernors that he will not impede their seisin of lands, etc.

First party: Robert de Ferrers, earl of Derby.

Second party: Henry, son of the king of the Romans [Henry of Almain], William de Valencia [Valence], earl of Penebrok [Pembroke], John de Warenne, earl of Surrey, William de Bello Campo [Beauchamp], earl of Warewik [Warwick]; Roger de Somer'; Thomas de Clare; Robert Walerand; Roger de Clifford; Hamo Lestrange (extraneus), Bartholomew de Suthleg'; and Robert de Briwes, knights.

Place or subject: Whereas Henry and the others, at the instance of Robert de Ferrers, earl of Derby, bound themselves and their heirs, together with all their lands and tenements, to Edmund, son of Henry III [Edmund of Lancaster], and for the earl mainperned for paying to Edmund £50,000 sterling for the earl's ransom and that of his lands, the earl, wishing to make provision for the indemnity of his mainpernors, has handed over and committed to them all his lands and tenements, which the king and Edmund handed over to him in his delivery from prison. To hold to them and their heirs until full satisfaction has been made to Edmund or his heirs of that sum of £50,000 about the whole at the same time and once, just as in the earl's deed which he made to his mainpernors is more fully contained. The earl, wishing to look out for the security of his mainpernors, grants and promises in good faith to his mainpernors that the earl by no means comes in his own proper person to those lands and tenements or sends anyone to those lands and tenements, and does not exact or receive anything from the issues of those lands and tenements, and does not allow anything to be exacted or recieved in his name, until that £50,000 has been paid in full to Edmund, and until all those things which are contained in his deed are completed according to the form and tenor of the same. The earl also promises in good faith and firmly binds himself to his mainpernors that he will not impede the seisin of the mainpernors for those lands and tenements or allow it to be impeded in any way contrary to the abovesaid form.
