Place or subject: Whereas Henry and the others, at the instance of Robert de Ferrers, earl of Derby, bound themselves and their heirs, together with all their lands and tenements, to Edmund, son of Henry III [Edmund of Lancaster], and for the earl mainperned for paying to Edmund £50,000 sterling for the earl's ransom and that of his lands in the quindene of St John Baptist next to come in 53 Hen. III. The earl, hearing that he cannot make sufficient provision at present for the indemnity of his mainpernors, unless by the handing over of all his lands and tenements which the king and Edmund, his son, handed over to the earl in his delivery from prison, and the earl, wishing to look out for their security in this regard and to observe them as indemnified in all things, has handed over and committed all his lands and tenements with appurtenances to his mainpernors. To hold to them and their heirs until full satisfaction has been made to Edmund or his heirs for the said ransom. If the earl does not pay to Edmund that sum of money within that term or make satisfaction otherwise, then it will lawful for his mainpernors to hand over and assign all his lands and tenements to Edmund or his heirs, to hold to Edmund and his heirs or assigns freely and quietly, until the earl has made satisfaction for that sum of £50,000 to Edmund or his heirs at the same time and once. The earl also grants for himself and his heirs that the mainpernors or Edmund or their heirs immediately after the death of Margaret de Ferrers, countess of Derby, his mother, are to enter all his lands and tenements, which she holds in dower from the lands and tenements which were of William de Ferrers, late earl of Derby, his father, and have and hold them, together with the other lands and tenements in the abovesaid form. The earl, in addition, grants that the mainpernors or Edmund or his heirs or assigns are to have and hold all those lands and tenements and also those things which Margaret holds in dower after her husband's death, together with knights' fees, advowsons of churches, escheats and all other things belonging to those lands and tenements by any right until the earl has paid that sum to the mainpernors or Edmund or his heirs or assigns, in such a way that the fruits or issues of the lands and tenements, received from Edmund or his heirs in the meantime, are to be not at all accounted.
