Place or subject: Whereas John de Suleny, knight, gave and confirmed to Robert 60 acres of land upon le Brendes in the ward of Ottokesh [Uttoxeter] with the wood thereupon standing, just as is more fully contained in the charter completed between them, at length, to make full faith and security in the future, lest John could be defrauded or frustrated in any case for the yearly rent due for this land, in the year 1265 on Monday next before the Ascension in the abbey of Burthon [Burton], it was agreed between Robert and John in the presence of trustworthy men that Robert granted to John and his heirs and assigns and their heirs that, at their pleasure and will, without seeking the assent or agreement of any sheriff or other bailiff, they can distrain Robert by any way they wish by lands and tenements and all goods, moveable and immoveable, wherever they are found, towards the payment of 60s a year due for that land for the mean part at Michaelmas and for the other part at Easter, etc., provided that nothing is found in the land upon le Brendes, by which they can reasonably distrain at this time. But if in any case payment ceases at a suitable time and John or his heirs or assigns or their heirs incur any damage or loss in this matter, by a similar distraint, it will be lawful for John to distrain Robert towards receiving full satisfaction, unless it happens by judgement of the realm the land is awarded away from Robert or his heirs, in which case Robert is to restore the price of the crop standing thereupon to the same man.
