Description

Printed prize appeal from the Vice-Admiralty Court of Jamaica.

Captured ship: Nightingale (master Jonathan Downs).

History: an American vessel, bound from Nantucket to Nantucket, laden with whale oil; taken on 3 July 1776 by HMS Squirrel (Stair Douglas commanding) and HMS Maidstone (Alan Gardner commanding) and brought into Port Royal, Jamaica.

Appellant: The master.

Respondent: The captors and Philip Crespigny, HMPG.

>Bound printed appeal with manuscript decree of 15 March 1781.

Folios 398-407v, comprising folios 398-400v: case on behalf of the appellant; folios 401-402v: appendix to the appellants' case; folios 403-404v: case on behalf of the respondent; folios 405-407v: appendix to the respondents' case.

Session of Thursday 15 March 1781, in the Council Chamber, Whitehall: sentence recorded in manuscript on folio 404v:-

  • Present: Henry, Earl Bathurst, Lord President of the Council; Earl of Sandwich; Earl of Clarendon; Sir John Eardley Wilmot; Sir Thomas Parker; Sir Richard Worsley.
  • Nightingale, Jonathan Downs master. Gostling junior. Crespigny. For sentence on the second assignation and informations.
  • "The Lords having heard informations and counsel on both sides by their interlocutory affirmed so much of the sentence of the judge below and condemnd the ship and cargo but reversed that part which condemned the claimant in double costs and gave only single costs to the time of the sentence in the court below."
