Description

Printed prize appeal from the Vice-Admiralty Court of Dominica.

Captured ship: Union (previously Perkins) (master John Parr, previously William Jenkins deceased).

History: a British vessel, bound from St Augustine, Florida to Bristol, laden with not mentioned; taken on 14 March 1778 by privateers Harlequin and William and Sarah and brought into Dominica.

Appellant: John Parr merchant of London, for the ship Union.

Respondent: Thomas Perkins, for the ship as Perkins.

Bound printed appeal with manuscript decree of 9 December 1780.

Folios 345-352v, comprising folios 345-346v: case on behalf of the appellant; folios 347-348v: appendix to the appellants' case; folios 349-350v: case on behalf of the respondent; folios 351-352v: appendix to the respondents' case.

Session of Saturday 9 December 1780, in the Council Chamber, Whitehall: sentence recorded in manuscript on folio 350:-

  • Present: Henry, Earl Bathurst, Lord President of the Council; Earl of Denbigh; Viscount Stormont; Lord Loughborough Chief Justice of His Majesty's Court of Common Pleas; Sir Thomas Parker.
  • The Union formerly the Perkins, John Parsons [sic] now and William Jenkins late master. Grene. Jenner. For sentence on the second assignation and informations.
  • "The Lords having heard the proofs and counsel on both sides by their interlocutory decree reversed the decree of the judge below, overuling the protest and directing the proctor of the appellant to appear absolutely and their lordships admitted the protest made in this cause and dismissed the appellant."
