Description

Printed prize appeal from the High Court of Admiralty.

Captured ship: Santa Mariana (master Roman Soris).

History: a Spanish vessel, bound from Malaga to Dublin, laden with brandy, wine, barilla, canes or reeds, aniseed; taken on 8 July 1779 in about 50 leagues off Cape St Vincent by HMS Hussar (Elliot Salter commanding) and brought into Lisbon.

Appellant: Edward Byrne merchant of Dublin, for part of the cargo.

Respondent: The captor.

Bound printed appeal with manuscript decree of 9 December 1780.

Folios 309-324v, comprising folios 309-310v: case on behalf of the appellant; folios 311-316v: appendix to the appellants' case; folios 317-318v: case on behalf of the respondent; folios 319-324v: appendix to the respondents' case.

Session of Saturday 9 December 1780, in the Council Chamber, Whitehall: sentence recorded in manuscript on folio 318v:-

  • Present: Henry, Earl Bathurst, Lord President of the Council; Earl of Denbigh; Viscount Stormont; Lord Loughborough Chief Justice of His Majesty's Court of Common Pleas.
  • The Santa Mariana, proceeded against by the name of La Santa Maria Anna, Roman Soris master. C Bishop. Crespigny. For sentence on the second assignation and informations."
  • The Lords by consent recived the attestations of property brought in by C Bishop and having heard the proofs and counsel on both sides by their interlocutory decree reversed so much of the sentence or decree of the judge below appealed from as condemning the goods claimed by Edward Byrne and decreed the same to be restored or the value thereof to be paid to the said Edward Byrne the claimant and appellant."
