Description

Printed prize appeal from the High Court of Admiralty.

Captured ship: Hertiginnan of Sodermanland (master Petter Alfwing).

History: a Swedish vessel, bound from Havana to Cadiz, laden with sugar, logwood, mahogany, sarsaparilla, tar, iron, coffee, rum, indigo, hides, snuff, cochineal and 300 Spanish dollars; taken on 9 September 1779 about 75 leagues east of Bermuda by HMS Aurora (James Cumming commanding) and brought first into Dover, and then into London.

Appellant: The master.

Respondent: The captor and Philip Crespigny, HMPG.

Bound printed appeal with manuscript decree of 9 December 1780.

Folios 283-308v, comprising folios 283-284v; attestation of the owners that Swedish ships have been used to trade with New Spain in peacetime; folios 285-285v: case on behalf of the appellant; folios 286-293v: appendix to the appellants' case; folios 294-295v: case on behalf of the respondent; folios 296-308v: appendix to the respondents' case.

Session of Saturday 9 December 1780, in the Council Chamber, Whitehall: sentence recorded in manuscript on folio 295v:-

  • Present: Henry, Earl Bathurst, Lord President of the Council; Earl of Denbigh; Viscount Stormont; Lord Loughborough Chief Justice of His Majesty's Court of Common Pleas; Sir Thomas Parker.
  • Hertiginnan of Sodermanland, Peter Alfwing master. Grene. Crespigny. For sentence on the second assignation and informations.
  • "The Lords having heard the proofs and counsel on both sides by their interlocutory decree affirmed the sentence of the judge below and ordered the cause to be remitted."
