Description

Printed prize appeal from the High Court of Admiralty.

Captured ship: Nossa Senhora da Boa Viagem (master Antonio da Costa Leal).

History: a Portuguese vessel, bound from Lisbon to Le Havre, laden with oil, brazil wood, cotton, sarsaparilla, lemons and wine; taken on 26 June 1779 by the privateer Amazon (Charles Lowe Whytell commanding) and brought into Liverpool.

Appellant: The master.

Respondent: The captor.

Bound printed appeal with manuscript decree of Tuesday 5 December 1780.

Folios 257-282v, comprising folios 257-264v: case on behalf of the appellant; folios 265-269v: case on behalf of the respondent; folios 270-282v: appendix to the respondents' case.

Session of Tuesday 5 December 1780, in the Council Chamber, Whitehall: sentence recorded in manuscript on folio 234v:-

  • Present: Henry, Earl Bathurst, Lord President of the Council; Earl of Hillsborough; Viscount Stormont.
  • Nossa Senhora da Boa Viagem, Antonio da Costa Leal master. Mr Lushington. Gostling junior. Crickitt. For sentence.
  • "Their Lordships having maturely considered the matter by their interlocutory decree reversed the sentence of the judge below and pronounced the ship to belong to a Portuguese subject as claimed and decreed the said ship and cargo to be restored to the master and claimant for the use of the proprietors. The Lords at the petition of Lushington directed the captor to bring in an account of the sales of the ship and cargo. Gostling brought in two attestations with three exhibits."
