Description

Printed prize appeal from the High Court of Admiralty.

Captured ship: George (master Aaron Sheffield).

History: an American whaling vessel, with a British flag (200 tons, 12 men including 2 enslaved men, one the property of the widow Champlin and the other of merchant Briggs, both of Newport), bound from Rhode Island at least three months before 1 January 1776 [and so not affected by the Prohibitory Act], via the Southern Whale Fishery at the Falkland Islands and the whale fishery off the coast of Brazil and of Guinea, West Africa, to London, laden with whale oil, spermaceti, whalebone, and stores; taken on 11 July 1776 near Dover by HMS Greyhound (John Bazely commanding) and the Customs cutter Tartar (Henry Jolly commanding) and brought into the Downs.

Appellant: The captor John Bazely.

Respondent: The master.

Bound printed appeal with manuscript decree of 21 November 1780.

  • folios 222-223v: case on behalf of the respondent;
  • folios 224-228v: appendix to the respondents' case.

Session of Tuesday 21 November 1780, in the Council Chamber, Whitehall: sentence recorded in manuscript on folio 223v:-

  • Present: Henry, Earl Bathurst, Lord President of the Council; Earl of Hillsborough; Earl of Clarendon; Lord Loughborough, Chief Justice of HM Court of Common Pleas.
  • The George, Aaron Sheffield master. For sentence on the second assignation and informations.
  • "The Lords having heard proofs and counsel on both sides by their interlocutory decree affirmed the sentence of the judge below and decreed the cause to be remitted amd condemned the appellant in one hundred pounds by way of costs. Monition for payment 15 days after service not to be extracted under 15 days."
