Description

Printed prize appeal from the High Court of Admiralty.

Captured ship: Eenigheit or Eenigkeit (master David Schultz).

History: a Prussian vessel, bound from Bordeaux to Stettin, laden with coffee, cocoa, tobacco, indigo, rice, wine, argol, turpentine, rosin, fruit and sugar; taken on 12 September 1778 by the privateer Union (Robert May commanding) and brought into Dover.

Appellant: Frederick Rasch merchant of London, and Peter Anker and Paul Amsinck for parts of the cargo.

Respondent: The captor.

Bound printed appeal with two manuscript decrees of 15 April 1780 and 19 July 1781.

Folios 149-191v, comprising:-

  • folios 149-153v: case on behalf of the appellant Frederick Rasch, merchant of London, on behalf of several Prussian subjects;
  • folios 154-170v: appendix to the case of Frederick Rasch;
  • folios 171-173v: case of the appellant Peter Anker, Danish consul in London, on behalf of the Royal Danish West India Chartered Company;
  • folios 174-177v: appendix to the case of Peter Anker;
  • folios 178-179v: case on behalf of the appellant Paul Amsinck, merchant of London, on behalf of Berlin merchants;
  • folios 180-181v: appendix to the case of Paul Amsinck;
  • folios 182-185v: case on behalf of the respondent to the three appeals;
  • folios 186-191v: appendix to the respondents' case.

Session of Saturday 15 April 1780, in the Council Chamber, Whitehall: sentence recorded in manuscript on folio 184v:-

  • Present: Lord Chancellor; Lord President; Lord Privy Seal; Earl of Denbigh; Earl of Sandwich; Earl of Marchmont; Lord George Germain; Lord Stormont; Viscount Howe.
  • Die Enigkeit, David Schultz master. Crickitt. Gostling junr. C Bishop. For sentence on the second assignation and information.
  • "The Lords having heard the proofs read and counsel on both sides by their interlocutory decree reversed that part of the decree of the judge below appealed as condemned the good claimed by Peter Anker, Frederick Rasch and Paul Amsinck and decreed the same to be restored to the respective claimants for the use of the proprietors thereof and condemned the captors in the costs of the appeal."

Session of Thursday 19 July 1781, in the Council Chamber, Whitehall: sentence recorded in manuscript on folio 184v:-

  • Present: Henry, Earl Bathurst, Lord President of the Council; Earl of Clarendon; Viscount Stormont; Lord Loughborough Chief Justice of HM Court of Common Pleas.
  • Enigkeit, David Schultz master. Crickitt. Gostling junr. Heseltine. C Bishop. A petition of the claimants of the cargo that the captor should pay the amount of the invoice and not according to the account of sales.
  • "The Lords having heard counsel on the petition of the proctors directed the restition [restitution] to be according to the original invoices with interest on the money the goods sold for and in the captors hands."
